Common Injuries
You do not have to leave the Armed Forces before you can claim. Even if the
accident was abroad, if the claim is against the
Ministry of Defence, it can be brought before the
English Courts.
Military personnel can also claim under the
Criminal Injuries Compensation (overseas) Scheme. This compensates personnel when they have been victims of violence whilst posted overseas.
When the injured party is not mentally capable of dealing with their own legal matters then the usual 3 year rule may not apply.
